Usage and Device Information: Automatically collected data, including IP address, browser type, operating system, device identifiers, pages viewed, time spent on Site, referral sources, and interaction data, via cookies, web beacons, and analytics tools (e.g., Google Analytics; planned: Hotjar for heatmaps/user feedback).


Service-Related Data: For MYSTIC/services with user accounts/logins, we collect and store data long-term as needed to create/maintain accounts (e.g., credentials, preferences). If you upload video feeds or imagery for enhancement, we collect non-personal technical data such as metadata from sensors (EO, IR, SAR) or footage details. Uploaded content is processed temporarily and deleted unless retained with consent for ongoing account use or pilots. For EU/UK/CA users, any personal data in uploads is minimized and protected.


Payment Information: When using Stripe for payments (planned), we collect billing details (processed securely by Stripe; we do not store card numbers).


Other Information: Aggregated or anonymized data from Site usage or service interactions.

We do not collect sensitive personal information (e.g., racial origin, health data) unless voluntarily provided for specific service purposes. For defense or security users, uploaded data may include mission-critical visuals but is treated as non-personal unless it contains identifiable information.

How We Use Your Information

We use collected information to:

Create, maintain, and secure user accounts/logins for MYSTIC/services, including authentication and personalization.


Operate and improve the Site and services, including providing AI-driven visual enhancements and responding to inquiries.


Communicate with you, such as sending updates, newsletters, or demo invitations.
Process payments via Stripe (planned).


Analyze usage patterns to enhance user experience, security, and performance (e.g., via Google Analytics/Hotjar).


Comply with legal obligations, prevent fraud, enforce our terms, or protect our rights, property, or safety.


For defense tech scaling: Support pilots, integrations, or DoD-related inquiries, ensuring data is used only for requested enhancements without fabrication.

We process data on a lawful basis, such as consent (e.g., account creation), contract performance (e.g., service delivery), or legitimate interests (e.g., Site security). For GDPR users, processing is based on consent or necessity for contracts.

Sharing and Disclosure of Information

We may share information with:

Service Providers: Third parties for hosting (e.g., AWS, including GovCloud for sensitive data), analytics (e.g., Google Analytics/Hotjar), payments (e.g., Stripe), bound by confidentiality and data protection agreements compliant with NIST 800-171 and CMMC. For defense users, we prioritize FedRAMP/CMMC-certified providers.

Business Partners: In collaborations, pilots, or integrations (e.g., DoD/NATO partners), with your consent.


Legal Requirements: To comply with laws, subpoenas, government requests (e.g., national security), or in mergers/acquisitions.


Aggregated Form: Non-personal, anonymized data for research or marketing.

We do not sell personal information as defined under CCPA/CPRA/GDPR.

Data Security

We implement industry-standard measures, including encryption, access controls, regular audits, and compliance with NIST 800-171 for defense pilots/CMMC pursuit. Data is hosted on AWS GovCloud for sensitive/controlled unclassified information. However, no system is infallible; we cannot guarantee absolute security.

Data Retention

We retain personal information only as long as necessary for the purposes described (e.g., account maintenance) or as required by law (e.g., audit trails). Uploaded footage is deleted immediately after processing unless retained with consent for ongoing account use. Account data is stored long-term until a deletion request is received.

For non-cloud, local (on-premise) deployments of MYSTIC or our AI agents, no user data, including uploaded footage or processed outputs, is ever transmitted to or stored on Absentia Technologies' servers or any cloud infrastructure. In these configurations, all data remains solely on the customer's local hardware and is never persisted beyond the immediate processing session unless the customer explicitly configures their own retention policies.

Your Rights and Choices

Access, Correction, Deletion: Request to view, update, or delete your data/account.


Opt-Out: Unsubscribe from marketing via email links or contact us. CCPA/CPRA rights include opt-out of sales (though we do not sell data) and limit sensitive data use.


GDPR Rights (EU/UK): Rights to access, rectification, erasure, restriction, portability, objection; withdraw consent anytime.


Do Not Track: We do not respond to browser DNT signals but honor opt-outs.


Contact us to exercise rights; we respond within 45 days (extendable under CCPA/CPRA) or one month (extendable under GDPR).

International Data Transfers

Data is processed in the U.S. For EU/UK/CA users, we use safeguards like standard contractual clauses or adequacy decisions.

Eligibility and Use

You must be at least 18 years old to use the Site/Services. You agree to use them lawfully, not for unauthorized purposes (e.g., reverse-engineering, uploading malicious content), and in compliance with applicable laws, including export controls. For Services requiring accounts/logins, you must provide accurate information and maintain security (e.g., passwords).

Intellectual Property

All content, AI models (e.g., GHOST, SPECTER), software, and technology are owned by Absentia or licensed to us. You are granted a limited, non-exclusive license for authorized use. No rights are transferred.

User Content and Services

If you create an account or upload data for enhancement (e.g., footage), you grant us a license to process/store it long-term as needed for account maintenance and Services. You represent that you have rights to such content and it complies with laws (e.g., no classified data without authorization). Services are provided "as is"; see Disclaimer below.

Prohibited Conduct

You may not: interfere with Services, introduce viruses, or use for illegal activities. For defense users, unauthorized use in military applications may violate export laws.

Payments

Payments via Stripe (planned) are subject to Stripe's terms; we do not store payment details.

Termination

We may suspend/terminate access/accounts for violations, without liability.

Limitation of Liability

To the fullest extent permitted by law, Absentia is not liable for indirect, consequential, or incidental damages arising from Site/Services use, including in critical defense applications.

Indemnification

You agree to indemnify us against claims from your use or content.

Governing Law and Dispute Resolution

These Terms are governed by South Carolina laws, without conflict principles. Disputes shall be resolved in Charleston, SC courts.

Outputs are based on user inputs and real-world data without fabrication but are not guaranteed error-free, especially in degraded environments (e.g., fog, low-light).

For defense/critical applications (e.g., ISR, SOF operations): Outputs are informational tools only; do not rely solely on them for mission decisions without human verification and independent validation. We disclaim liability for losses, injuries, or damages from use, including in high-risk scenarios.

Export Controls and Compliance Notice

Absentia Technologies' products, software, and technology (including MYSTIC and AI agents) are dual-use items and may be subject to U.S. export controls under the Export Administration Regulations (EAR) administered by the Bureau of Industry and Security (BIS). Absentia Technologies is not subject to the International Traffic in Arms Regulations (ITAR), as our AI-driven visual enhancement solutions do not constitute defense articles or services listed on the United States Munitions List (USML).

Key Points

  1. Our technology is classified as dual-use under EAR, meaning it has both commercial and potential military applications (e.g., real-time image enhancement for ISR, security, or navigation).

  2. Exports, reexports, or transfers of our software, technology, or related technical data may require a license depending on the destination country, end-user, end-use, or specific classification (e.g., potential ECCN under categories like 4D/4E for AI-related software/technology).

  3. We do not export to embargoed countries, denied parties, or for prohibited end-uses (e.g., nuclear, missile technology) without proper authorization.

Prohibitions and Responsibilities

Users must comply with EAR requirements, including:

  • Screening for restricted parties/countries.

  • Obtaining any necessary BIS licenses or utilizing license exceptions where applicable.

Non-Cloud/Local Deployments

In on-premise, local (edge/non-cloud) configurations of MYSTIC or our AI agents, no user data—including uploaded footage or processed outputs—is transmitted to or stored on Absentia Technologies' servers or any cloud infrastructure. All data remains solely on the customer's local hardware and is never persisted beyond the immediate processing session unless the customer configures their own retention policies.

Violations of export control laws may result in severe penalties, including fines and loss of export privileges. Users are solely responsible for determining their compliance obligations and obtaining any required authorizations.
